BANEMA Construcción, Pinturas y Revestimientos S.L. is a well-known and highly regarded construction company in Spain, recognised particularly for its major project delivery and specialist finishing works.

In the year 2022, BANEMA was responsible for the construction of the Riu Palace Mauritius and Riu Turquoise hotel resorts, both flagship properties of the international Riu Hotel Group. During this period, Me. Al Assad Peeroo acted as instructing Barrister for BANEMA in Mauritius for over 18 months, representing not only the company but also providing extensive legal support connected to its workforce of approximately 2,000 foreign workers engaged on the developments.

His mandate during this engagement notably included the following areas of work:

• Given that BANEMA’s turnover exceeded the legal requirement, Me. Al-Assad Peeroo applied to the Economic Development Board for BANEMA being registered as a construction company, to which BANEMA secured Gade A, the highest and most exclusive contractor grade in Mauritius;
• Coordination and submission of large-scale visa applications for approximately 2,000 foreign workers supporting the hotel developments;
• Oversaw mass submission of Occupation Orders and work-permit documents to the Economic Development Board for all 2,000 workers;
• Advised BANEMA on workers arrivals, coordinating with authorities to ensure smooth entry of all personnel into Mauritius;
• Liaised with relevant authorities to prevent delays or issues for incoming workers;
• Advised on documentation requirements for drafting immigration letters and compliance submissions;
• Document verification, legal review and authentication oversight for immigration and labour compliance, processing, and uploading for Occupation Orders, covering all workers, including:
  • Birth certificates
  • CVs and employment contracts
  • Job descriptions
  • Passports and passport photos
  • Educational/professional certificates
  • Business Registration Numbers (BRN) and Certificates of Incorporation (COI)
  • Company briefs and letters of undertaking

• Drafting, reviewing and finalising corporate and employment contracts, including contractor agreements related to the hotel projects;
• Negotiations and compliance discussions with the Ministry of Labour and Industrial Relations at the time;
• Personal accompaniment of several workers to appointments with:
  • the EDB
  • the Passport and Immigration Office (PIO)
• Drafting worker-specific immigration correspondence, including:
  • Letters of invitation
  • Letters of undertaking and support
  • Letters for visa-extension applications
  • Letters of undertaking for worker compliance filings
  • Official immigration letters to support visa and visa-extension requests
